Eligible countries for the H-2A and H-2B visa programs in 2024

The Department of Homeland Security (DHS), in consultation with the Department of State (DOS), has announced the list of countries eligible for the H-2A and H-2B visa programs for 2023-2024. The H-2A program covers agricultural jobs, while the H-2B program includes non-agricultural temporary work.

The H-2 visa programs provide U.S. businesses with a legal pathway to hire temporary foreign workers for specific roles when there are insufficient U.S. workers to fill those positions.

Bolivia has been added to the list, while Mongolia and the Philippines are eligible only for the H-2B program. This designation is valid from November 9, 2023, to November 8, 2024. Nationals from the following countries are eligible to apply for the H-2A and H-2B visas:

Understanding the H-2 Visa Programs

The H-2A visa program allows U.S. employers to hire foreign agricultural workers for seasonal or temporary work. The H-2B visa program, on the other hand, is aimed at filling temporary or seasonal non-agricultural jobs, such as those in hospitality, construction, or landscaping.

Employers seeking to hire H-2 workers must demonstrate that:

  • There are not enough U.S. workers able, willing, qualified, and available to do the temporary work.
